Terms of Sales

These general conditions of sale create a legal agreement and apply to all orders and sales of services and products concluded between the customer and the photographer Enola Dovetta Photographie, Enola Dovetta Fernandes, 22 rue buffon, 21000 Dijon, France , VAT: FR83890666084, SIREN: 890666084, SIRET: 89066608400011,.

The photographer reserves the right to modify these general conditions at any time. Each order is governed by the general conditions applicable on the date of the order.

Article 1: object
Enola Dovetta Photography offers private and public photographic services as presented on

its website: www.enoladovetta.com.
The fact of reserving a session is equivalent to placing an order by the customer and entails unreserved acceptance of these general conditions of sale, except special conditions granted by the photographer to the customer.
Any document other than these GTC and in particular catalog, prospectus, advertisements, notices, is only informative and indicative, not contractual.
These general conditions of sale form an indivisible contractual document with the service contract signed by the customer.

 

Article 2: order
The reservation of a photographic service is made exclusively by email or telephone (according to the

contact information provided on the photographer's website) or via the client interface of the fotostudio.io platform.
Any order is accepted upon receipt of the deposit and must be validated by a contract signed by the customer including practical information (date, place, ...). The latter can be signed online via the fotostudio.io platform or returned signed to the photographer by sending an email.
In the absence of payment of the deposit and receipt of the contract within 7 days following the sending of the contract by the photographer, the photographer does not undertake to keep the date.

 

Article 3: prices and terms of payment
The prices are displayed inclusive of all taxes and depend on the prices applicable on the date of the order. If they are

may vary thereafter, any previously fixed service will keep the price applied when the order is taken.
Travel or accommodation costs may be applied. They will then be included in the estimate.
The quotes established by the photographer are valid for 30 days.

A deposit of 30 euros will be requested to validate an order. It can be paid by bank transfer, or by online payment. (except marriage, 20% will be asked of you!)
The balance will be paid by the customer in cash on the day of the service or by transfer the day before the appointment, otherwise I will not accept you on the day of the appointment.

The non-payment of the balance results in the cancellation of the delivery of the photos, without reimbursement of the deposit received. The final delivery of the photos will only be made when the order is fully paid.

Article 4: modification of the service
Any request to modify a service requested by a customer can only be taken into account if the

request is sent by email to the photographer at least 7 days before the scheduled date of the service. In accordance with the legal provisions in force, the customer has a withdrawal period of 7 working days from the day after the day of the conclusion of the order. Any withdrawal request made within the time limit will result in the reimbursement of the deposit. Unless the service has already been carried out in whole or in part.
In the event of cancellation of the reservation of a photographic service that has become final, it is recalled that in accordance with legal provisions, the amount of the deposit will not be refunded, except in cases of force majeure for the customer.

 

Article 5: performance of the service
The photographs are taken by Enola Dovetta Photographie or, in the event of major impediment, by any other

photographer appointed in agreement with the client.
The photographer is not subject to an obligation of result. He makes every effort to provide quality images, as stipulated in the order. The content of these images is left to the artistic appreciation of the photographer.
Accordingly, customers acknowledge that photographs are not subject to rejection based on customer taste.

 

Article 6: obligations of the client

The time fixed for the service is imperative and any delay by clients may be charged against the time previously agreed for the session. Beyond 15 minutes late, the session will be canceled and the deposit will not be refunded.
Customers declare that they are of legal age, pose freely for photos and, if necessary, authorize shots of their children according to the style  photographic they wish.
The photographer may not be hampered during his service by amateur photographers, or phone shots.
The children present during the photoshoots remain under the full responsibility of the parents. In the event of material damage caused by the client or the child or any other person present in the studio, these must be reimbursed in full.

Article 7: post-processing
The photographer never delivers raw photographs. Post-processing, like shooting, is

specific to the photographer and is an integral part of his work, his style and his artistic universe. The photographer is the only one to decide on the post-processing he will apply.
Any additional retouching requested by the client will be accepted or not by the photographer who reserves the right to invoice the additional work per image according to the rates in force.

Only the photographs processed by the photographers will be usable by both parties.

Article 8: delivery
Enola Dovetta Photography makes every effort to ensure delivery of the photos as soon as possible (maximum two months).
A private gallery will be assigned to you, you will have 48 hours to make your choice, after delivery of the photos retouched by the photographer. Beyond that, the gallery will be deleted, and if you want it to be put back online, this will incur costs of 80 euros including tax.
A delay in delivery or performance cannot be invoked by the customer to request the termination of the contract, claim damages or assert any other claim.
The selected and edited photos are sent to the customer by download link or via a private gallery accessible by password.
The delivery of digital files is in the form of JPEG files. The other files are the property of the photographer and will not be returned to the customer under any circumstances.

Article 9: retention period
From their delivery to the customer, the photographs are kept and archived in their entirety.

Article 10: responsibilities

10.1 Adverse atmospheric conditions
In the event of degraded atmospheric conditions such as, for example, thunderstorms, storms, heavy rains, etc., the photographer cannot be held responsible for the non-performance or partial performance of the outdoor services initially provided for in the order.
No refund will be made, the session will be postponed to a later date.
10.2 Force majeure or illness
An unforeseeable external event making it impossible to perform the service is considered force majeure (accident, death of a parent, COVID19, etc.). Each of the parties may oppose this right as soon as force majeure is characterized.
Enola Dovetta Photographie reserves the right to cancel / postpone a photographic service in the event of force majeure or illness. Such cancellation can neither engage its liability nor give rise to the payment of damages for any reason whatsoever. The meeting will be postponed to a later date.
As part of a wedding, the photographer agrees to do his best to help clients find another service provider available to perform the service.
The full amounts paid will not then be reimbursed without giving rise to the payment of damages for any reason whatsoever.
10.3 Technical problem and accident
In the event of a technical problem with the photographic equipment or of any accident during the service preventing the photographer from delivering the requested work, the full amount paid will be refunded, without giving rise to the payment of damages for any reason. whether it be.
In the event of loss or deterioration of the photos before their delivery (burglary, fire, etc.), the customer can only claim reimbursement of the service.

Article 11: intellectual property
The photographs taken during a session with the client are protected according to the rules of articles L 121-1 and the

Law of March 11, 1957 (Code of Intellectual Property and Copyright).
Even after the digital files have been transferred, the photographs remain the intellectual property of the photographer and are therefore not free of rights. The commercial use by the Client of the images of his session is not authorized, and must be the subject of a new written agreement with the photographer.
Any personal use of a photograph, whatever it is and whatever its uses (publication on

internet, exhibition, ...) must mention the name of Enola Dovetta Photography.
The customer holds the rights to print and reproduce the photos for private purposes only unless previously agreed.

 

Article 12: image rights
The photographer reserves the right to use the photographs he has taken for the purposes of promoting his

activity (website, social networks, exhibitions, ...). The customer must agree or disagree when signing the contract.
In case of refusal, the customer cannot refuse the use of photos on which he is not recognizable. Likewise, any photo published publicly (internet, social networks, etc.) by the client may be used by the photographer.

Article 13: personal data
The personal information collected when placing an order is intended exclusively for

ensure customer management and in particular the follow-up of reservations with a view to the successful completion of the service ordered.
The photographer undertakes not to communicate this information to third parties for any reason whatsoever.

Article 14: applicable law
The contractual relations between parties to which these general conditions apply are governed.

Any dispute relating to the formation, execution or interpretation of these general conditions as well as any agreements to which they apply, will, in the absence of an amicable agreement, be subject to the exclusive jurisdiction of the French courts and more particularly city courts
